MR. YANNETTI: Good morning, Judge. David Yannetti for Karen Read.

13 21:00

JUDGE CANNONE: Good morning, Mr. Yannetti. Good morning, Miss Read. Good morning, jurors. I have to ask you those same three questions. Were you able to follow the instructions and refrain from discussing this case with anyone since we left here yesterday? Everyone said yes and nodded affirmatively. Were you also able to follow the instructions and refrain from doing any independent research or investigation into this case? Yes, everyone said yes and nodded affirmatively. Did anyone happen to see, hear, or read anything about this since we left yesterday? Everyone said no or shook their heads. So while you bring your witness in, Mr. Lally, I'd like to see counsel at sidebar for a brief minute.

14 27:12

COURT OFFICER: Order. Do you swear to tell the truth, the whole truth, and nothing but the truth, so help you God?

15 27:34
16 27:36

COURT OFFICER: Thank you.

17 27:39

JUDGE CANNONE: Whenever you're ready, Mr. Lally.

18 27:41

MR. LALLY: Thank you, your honor. Now I have a few more questions for you. So I can turn your attention to the period of time we testified about yesterday, when you're at — Mr. O'Keefe is in the back of the ambulance. Um, with respect to his clothing, what if any observations did you make in regard to that clothing?

19 28:10

MS. MCLAUGHLIN: Um, he had — in terms of what he was wearing, first, in terms of what he was wearing, uh, he was wearing jeans. He had on um a dark-colored uh light zip-up jacket, um, and I noticed one sneaker.

20 28:29

MR. LALLY: Now with regard to that clothing, what if any observations did you make in regard to the condition of that clothing?

21 28:40

MS. MCLAUGHLIN: Um, it was uh soaked through.

22 28:43

MR. LALLY: As far as um tears or holes or anything else with regard to that clothing, what if any observations did you make?

23 28:54

MS. MCLAUGHLIN: I didn't see any.

24 28:56

MR. LALLY: Miss Gilman, if I could have Exhibit Number 18. May I approach the witness?

25 29:04
26 29:04

MR. LALLY: Okay. Now first, ma'am, do you recognize what's up on the screen as Exhibit 18?

27 29:12

MS. MCLAUGHLIN: Do I recognize what it is? Yes, um, yes.

28 29:17

MR. LALLY: And what do you recognize it to be?

29 29:21

MS. MCLAUGHLIN: Um, the address of the call — 34 Fairview Road.

30 29:27

MR. LALLY: Now with respect to the photograph — you observed — or uh, where Mr. O'Keefe was on the ground when you first arrived — um, from this angle, can you identify it?

31 29:44

MS. MCLAUGHLIN: From this angle, no, I don't.

32 29:47

MR. LALLY: And if you could — it was not on the photograph, is it?

33 29:54
34 29:54

MR. LALLY: Off to the left or right, or where would it be in relation to this photograph?

35 30:03

MS. MCLAUGHLIN: Uh, to the left, I would say.

36 30:07

MR. LALLY: And uh, about how far off frame do you believe it was?

37 30:13

MS. MCLAUGHLIN: Um, I'm not sure. So my view of the call — my reference point wasn't a house on either side. Um, the patient was off the road, um, so my view of this call was the patient was uh on the side of the road. The only thing that I noted was a fire hydrant. So, in relation to — I know it was to the left of the house, um, but I'm not sure exactly how far left it would be from this picture, from this angle.

38 31:00

MR. LALLY: So your memory is to the left of the house, near a fire hydrant — is that correct?

39 31:10
40 31:11

MR. LALLY: Take that down. I have no further questions.
