COURT OFFICER: Hear ye, hear ye, hear ye. All persons having any business before the Honorable Beverly Cannone, Justice of the Norfolk Superior Court and for the County of Norfolk, draw near, give your attendance. You shall be heard. God save the Commonwealth of Massachusetts. This court is now open. You may be seated.
COURT CLERK: 22-117, Commonwealth versus Karen Read.
JUDGE CANNONE: Good morning, counsel. Good morning, Ms. Read. Good morning, jurors. THE JURORS: Good morning (in unison).
JUDGE CANNONE: I have those same three questions for you. Were you all able to follow the instructions and refrain from discussing this case with anyone since we left yesterday? Everyone said "yes" or nodded affirmatively. Were you also able to follow the instructions and refrain from doing any independent research or investigation into this case? Everyone said "yes" or nodded affirmatively. Did anyone happen to see, hear or read anything about this case since we left here yesterday? Everyone said "no" or shook their heads. All right. With that, Mr. Foreman, I am sending you and the rest of the jurors out to deliberate.
(Whereupon, the jury exited the courtroom to resume deliberations at 9:04 a.m.)
JUDGE CANNONE: All right. The same as yesterday. Please stay in the building until 10:00 o'clock. Be back here at 3:30. If you leave the building, let the court officers know where you are going to be and be prepared to be back in your seats within five minutes. Okay? Thank you.
MR. JACKSON: Thank you, Your Honor.
MR. LALLY: Thank you.

COURT OFFICER: Court is back in session. You may be seated.
JUDGE CANNONE: The jury indicates they want to go home, but I'd like to see counsel at sidebar, please.
(Whereupon, there was a sidebar conference as follows:
JUDGE CANNONE: So that's my inclination. Is there an objection to that?
MR. JACKSON: No.
MR. LALLY: No objection.
JUDGE CANNONE: Okay. Do we need to bring her in here? I'm reluctant to bring somebody into court with all of the attention that's going on.
MR. JACKSON: Agreed.
MR. LALLY: Agreed.
JUDGE CANNONE: So I would like to -- Officer Delano -- any objection to me just asking Paul to tell her it's okay?
MR. JACKSON: No.
MR. LALLY: No objection.
JUDGE CANNONE: Could you come over here, please? So we don't need to bring the juror into the courtroom.
COURT OFFICER: Sure.
COURT OFFICER: Sure.
COURT OFFICER: Absolutely.
JUDGE CANNONE: Thank you.
COURT OFFICER: Thank you, Judge.
JUDGE CANNONE: All right. With that, let's bring the jurors over and let them go home.

JUDGE CANNONE: Okay, jurors. We all appreciate how hard you've been working and I understand you'd like to stop for the day. So we will certainly do that. We appreciate everything you're doing. I do have to give you those same three cautions. Please do not discuss this case with anyone. Don't do any independent research or investigation into this case. If you happen to see, hear or read anything about this case, please disregard it and let us know. Clear your heads. We'll see you tomorrow morning. Thank you very much.
